Consumer Product Safety Improvement Act (CPSIA) Update
The Consumer Product Safety Improvement Act continues to be a critical issue impacting nearly every CHA member company. At CHA, we’re actively tracking all proceedings related to CPSIA and working to ensure that members have access to the information they need.

A CHA Task Force to address the CPSIA has been organized and is comprised of 15 different member organizations. CHA’s objectives in forming the task force are to:
  1. Help the craft industry comply with CPSIA requirements.


  2. Develop/issue best practices for CPSIA compliance.


  3. Become a valuable resource for members to obtain information for their respective businesses.


  4. Establish industry-wide agreement on CPSIA terms, definitions, etc.

  5. Become the voice for the craft industry in Washington, D.C., and exert influence on current and future legislation affecting the industry.
The initial meeting of the task force was conducted on February 24th and a summary of the meeting follows.

Definition of Children’s Products - A major issue in complying with the CPSIA is the definition of a “children’s product” as it relates to the craft industry. The current definition is open to interpretation, and the Consumer Product Safety Commission (CPSC) needs to be educated regarding the craft industry and the nature of the business. Specifically, it is a component industry versus one focused on finished goods. A sub-committee was formed to develop a Children’s Product Position Statement representing the craft industry’s point-of-view, which will be submitted to the CPSC.

Legal Counsel – The option of acquiring an outside “expert” to represent the CHA membership in dealing with the CPSC was agreed to by the task force. A legal firm with significant expertise in this field has been identified and negotiations are underway to employ their services.

Industry Testing Standards – While the only requirement by the CPSC is that all product testing be conducted by a certified lab, there are other factors to consider when selecting a facility, e.g. their capability to provide data electronically. The task force will develop a survey to assess the needs of members and then determine the capabilities of CPSC-approved facilities. The ultimate goal is to establish a CHA-endorsed set of approved testing labs that members can utilize.

Follow-up Webinar – The webinar planned as a follow-up to the CPSIA seminar at the CHA 2009 Winter Convention in Anaheim has been postponed. The decision was made to reschedule the session in order for the newly formed task force to have an opportunity to become familiar with the issues and employ outside counsel to answer questions during the tele-conference. The webinar is expected to take place in late March or early April, depending on how soon the legal representative can join the task force.
